A manufacturing client facing the need to asset finance the strategic installation of significant plant and machinery into a leasehold property which it occupied, in order to remain operationally competitive .
Our intervention at a key point, before the client committed to the installation and by implication made a commitment to the host leasehold premises way beyond the existing lease term, allowed the client to re-gear its lease. We negotiated a premium payment to our clients representing a share the value created for the landlord, thereby helping finance the plant and machinery acquisition and minimise finance burden on the business.
Furthermore, the re-gearing of the lease at the correct juncture, prevented the client’s intended actions creating a weak negotiating position at lease end.
Richard Murphy is currently advising a private client, where the directors are members of an extended family. The company owns a diverse portfolio of assets and we are developing with them a strategic plan for asset value maximisation and selective disposal and re-investment.
